1. Introduction
1.1 This document sets out the privacy policy of Hyperbridge Pty Ltd (ACN 695 768 828, ABN 85 695 768 828) (Hyperbridge, we, us or our) and explains how Hyperbridge collects, holds, uses and discloses personal information. Hyperbridge operates the Cognomine business name and provides the Cognomine hosted software service.
1.2 We take privacy seriously. This policy explains the kinds of personal information we collect and hold, how we collect, use, disclose and protect it, how long we keep it, and how you may access or seek correction of it or make a privacy complaint.
1.3 By using our website, creating or using an account, contacting us, or otherwise providing personal information to us, you acknowledge that we may handle your personal information as described in this policy.
1.4 We may update this policy from time to time. The updated policy will be published on our website and will apply from the date it is published. We encourage you to review this policy periodically.
2. Types of personal information we collect
2.1 The personal information we may collect and hold includes:
(a) your name, business email address, telephone number, job title, employer and other business contact details;
(b) account and authentication information, including your email address, password credentials where you create an account directly with us, and your email address where you access Cognomine using Google federated login;
(c) communications and correspondence with us, including enquiries, support requests, feedback and information you provide when participating in sales, onboarding or account-management discussions;
(d) information relating to your use of Cognomine, including account activity, login and session information, technical logs, and information required to provide, support, secure and improve the service;
(e) business and transaction information, including quotations, purchase order details, invoices, payment status and other records relating to a customer’s acquisition or use of our services;
(f) information collected for sales and marketing purposes, including your contact details, role, organisation and communications preferences; and
(g) any other personal information that you provide to us directly or that is otherwise required for us to provide our services.
2.2 We do not directly collect or store credit card or other payment-card information. Payments made through our website are processed by Stripe. We may also receive payment-related information from customers that pay by purchase order or invoice, including payment status and remittance information.
2.3 We do not intentionally collect sensitive information, precise location information or copies of identity documents. Please do not provide sensitive information to us unless we request it or you are required to provide it by law.
2.4 Cognomine allows customers to upload block models and other mine-planning data. Those materials are generally confidential commercial and technical information rather than personal information. The collection, use, protection and confidentiality of those materials are addressed in our agreement with the relevant customer. However, if a customer uploads material that contains personal information, we may handle that personal information to the extent reasonably necessary to host, operate, support, secure and improve Cognomine in accordance with our agreement with that customer.
3. How we collect personal information
3.1 We may collect personal information:
(a) when you create an account for, log in to, or use Cognomine, including through direct account registration or Google federated login;
(b) when you contact us by email, telephone, through our website or through another communication channel;
(c) when we communicate with you about a quotation, purchase order, subscription, invoice, support request or other commercial arrangement;
(d) when you provide your details to us in connection with sales, marketing, demonstrations, onboarding or account management;
(e) from the organisation you work for, including where that organisation nominates you as an authorised user or contact person;
(f) from publicly available sources and professional networking platforms, where permitted by law; and
(g) automatically when you access or use our website or Cognomine, through session-management technologies and service logs.
3.2 We currently use cookies and similar technologies only to manage user sessions, keep users signed in where applicable, and support the security and functionality of Cognomine. We do not currently use third-party advertising cookies, behavioural advertising tools or website analytics tools.
3.3 You may be able to disable cookies through your browser settings. However, if you disable cookies, parts of our website or Cognomine may not function properly.
3.4 If we introduce analytics, advertising, remarketing or other tracking technologies in the future, we will update this policy and, where required, provide any additional notice or obtain any consent required by applicable law.
4. How we use and disclose personal information
4.1 We may use personal information:
(a) to create and administer accounts and provide Cognomine and related services;
(b) to authenticate users, maintain service security, investigate suspected misuse and protect our systems, users and rights;
(c) to provide customer support, respond to enquiries and communicate with you about the service;
(d) to prepare quotations, process purchase orders, administer subscriptions or credits, issue invoices, manage payments and maintain business records;
(e) to manage our relationship with customers, prospective customers, authorised users, suppliers and other business contacts;
(f) to improve, test, maintain, develop and support Cognomine, our website and our business operations;
(g) to comply with legal obligations, resolve disputes, enforce our agreements and protect our legal rights;
(h) to send direct-marketing communications about our services that we think may be relevant to you, where permitted by law. You may opt out of receiving marketing communications at any time by using the unsubscribe facility in the communication or contacting us at support@hyperbridge.info; and
(i) for another purpose that is related to the above purposes and that you would reasonably expect, or otherwise where permitted or required by law.
4.2 We may disclose personal information to:
(a) our employees, directors, contractors and professional advisers where they need the information to perform their duties;
(b) our service providers that assist us to operate our business or provide Cognomine, including Stripe for online payment processing, Xero for accounting and invoicing, and Attio for customer relationship management;
(c) a customer organisation or account administrator, where you use Cognomine as an authorised user of that organisation;
(d) regulators, law-enforcement bodies, government agencies, courts or other parties where required or permitted by law; and
(e) a purchaser, prospective purchaser or other participant in a transaction involving a sale, restructuring, merger or transfer of all or part of our business or assets, subject to appropriate confidentiality arrangements.
4.3 We do not sell personal information.
4.4 We may generate and use aggregated or de-identified information derived from information we collect for service development, performance analysis, internal business planning and marketing. This may include aggregate statistics about use of Cognomine, such as the number of users or mine sites planned, and analysis of the types of organisations or roles represented among our customers. We will take reasonable steps to ensure that information used for these purposes does not identify you and is not reasonably capable of being re-identified.
4.5 We may use a customer’s name, logo, testimonial or case-study material for marketing purposes only with that customer’s prior permission. Where a testimonial identifies an individual, we will obtain that individual’s consent before using it.
5. Overseas disclosure
5.1 We use service providers that may handle personal information outside Australia, including Stripe, Xero and Attio. As a result, personal information may be disclosed to overseas recipients in connection with payment processing, accounting, invoicing and customer relationship management.
5.2 We may not always be able to specify the countries in which those overseas recipients are located, as this may depend on the relevant service provider’s infrastructure, personnel and subcontractor arrangements from time to time.
5.3 Where we disclose personal information to an overseas recipient, we will take steps that are reasonable in the circumstances to protect that information and comply with applicable privacy laws.
5.4 Block models and other material uploaded to Cognomine are stored in Australia. The Cognomine Terms of Service set out how we handle that material.
6. How long we keep personal information
6.1 We keep personal information only for as long as we need it for a purpose set out in this policy, or for as long as we are required to keep it by law.
6.2 Material uploaded to Cognomine, and the outputs generated from it, are deleted or de-identified within thirty (30) days after the relevant entitlement ends, except to the extent we are required by law to retain them or they remain in routine backup systems. This is set out in the Cognomine Terms of Service.
6.3 Business contact and transaction records, including records held in our customer relationship management and accounting systems, are kept while we have an ongoing relationship with you or with the organisation you work for, and afterwards for as long as we need them to meet legal, tax, accounting, record-keeping or dispute-resolution obligations.
6.4 When we no longer need personal information for any purpose set out in this policy, and we are not required by law or a court or tribunal order to retain it, we take reasonable steps to destroy it or to ensure that it is de-identified.
7. Security
7.1 We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. Our safeguards may include access controls, authentication measures, password protection, system-security measures and procedures designed to limit access to personal information to authorised personnel and service providers.
7.2 Cognomine is hosted and processed using infrastructure located in Australia, including Microsoft Azure and certain Amazon Web Services functionality.
7.3 However, no method of transmitting or storing information electronically is completely secure, and we cannot guarantee the absolute security of personal information.
8. Links to third-party websites
8.1 Our website or service may contain links to third-party websites or services. Those links are provided for convenience only. We are not responsible for the privacy practices of third parties, and we encourage you to review the privacy policy of each third-party website or service you use.
9. Accessing and correcting your personal information
9.1 You may request access to, or correction of, the personal information we hold about you by contacting us at support@hyperbridge.info. Please include sufficient information to allow us to verify your identity and identify the information you are requesting.
9.2 We will respond to an access or correction request within a reasonable period and, in most cases, within thirty (30) days. We may refuse access or correction in circumstances permitted by law. If we refuse a request, we will provide written reasons, unless it would be unreasonable to do so.
9.3 We may charge a reasonable fee for giving access to personal information, but we will not charge a fee merely for receiving or processing an access request, and we will not charge a fee for correcting personal information.
10. Privacy complaints
10.1 If you have a complaint about how we handle your personal information, please contact us at support@hyperbridge.info and provide details of your complaint.
10.2 We will acknowledge your complaint and investigate it. We will aim to respond within thirty (30) days. If we need more time, we will let you know.
10.3 If you are not satisfied with our response, you may have the right to complain to the Office of the Australian Information Commissioner. Information about making a complaint is available on the OAIC website.
